Kessler Matura P.C. has filed a class and collective action lawsuit on behalf of current and former Crew Members who worked for Looks Great Services (“LGS”), a commercial tree removal and disaster cleanup company.

The complaint alleges that LGS did not pay Crew Members their full overtime wages and the proper prevailing wages required by New York law. LGS paid Crew Members at a deflated hourly rate by misclassifying their work as Groundmen under NY prevailing wage schedules. Crew Members operated heavy machinery, making them Operating Engineers under the schedules, and entitling them to higher wage rates. LGS also failed to pay Crew Members overtime using the proper rate, in violation of federal and state law. As a result, the complaint seeks to recover the unpaid prevailing wages and overtime wages for Crew Members.
