RXO Last Mile, Inc. – Wage Deductions and Overtime Violations

Kessler Matura P.C. and co-counsel have filed a class action lawsuit on behalf of current and former delivery drivers who worked for RXO Law Mile, Inc. (previously XPO Last Mile, Inc.).

The complaint alleges that RXO’s drivers were misclassified as independent contractors, when they should have been treated as employees. As a result of this misclassification, RXO’s drivers were forced to bear the costs of doing business and had their wages deducted, bringing their hourly wage below the minimum wage rate of New York State. Further, drivers had to work long hours without the benefit of overtime pay.

This lawsuit seeks to recover back wages and related damages to all delivery drivers employed in New York since March 2017.
