EmblemHealth, Inc. – Unpaid Overtime

Kessler Matura P.C., together with the law firm of Outten & Golden, LLP, has filed a class action lawsuit on behalf of current and former employees in New York of EmblemHealth Inc. (“Emblem”).

We alleged that Emblem denied overtime pay to their Individual Insurance Sales Representatives (“IISRs”) and Marketing Sales Representatives (“MSRs”) by misclassifying them as exempt from overtime law. Emblem’s IISRs and MSRs educate and complete enrollment applications for eligible New Yorkers for free or low-cost government-subsidized health insurance. Emblem’s IISRs and MSRs worked for at locations throughout New York, including at Emblem offices, doctors’ offices, pharmacies, and community events. We allege that Emblem requires its IISRs and MSRs to meet daunting productivity requirements each workweek, forcing them to work in excess of 40 hours per workweek without overtime pay. This lawsuit seeks to recover these unpaid wages, along with liquidated damages, owed to those employed as IISRs and MSRs for Emblem who worked over 40 hours a week at any time since November 1, 2013.
