Age discrimination in the workplace

Older workers in New York who believe that they have experienced age discrimination on the job may have legal recourse. It is important that older workers are able to recognize the signs of age discrimination in the workplace and take the appropriate steps to address the issue.

One indication that age discrimination is occurring in the workplace is that a significant number of older workers are being terminated. It is not uncommon for an employer to fire older workers and hire younger applicants to take their place.

Older workers who are given undesirable reassignments within a company may also be victims of age discrimination. In order to avoid a lawsuit, an employer may relocate an older worker to an undesirable position so that they will be inclined to leave the company voluntarily.

Older workers may also be subject to comments, sometimes in the form of jokes, that make an issue out of their older age. The comments may be stated casually, such as a manager or supervisor innocently inquiring if an older worker is considering retiring.

Companies may also see fit not to give older workers the raises to which they are entitled. This might occur even as younger employees are steadily receiving income increases.

An attorney who practices employment law may advise a client who has been the victim of workplace age discrimination. Complaints may be filed with the appropriate federal agencies if the employer is believed to have violated federal laws. If necessary, a lawsuit could be filed to pursue financial damages.
