Abercrombie & Fitch Stores Inc. is a well-performing retailer that has claimed a significant portion of the clothing market. As such, its stores are often busy and its employees are expected to work long hours. Whenever an employee works over 40 hours per week, however, he or she is due overtime pay, which is a requirement under both federal and New York state laws. Should an employee be denied that pay, he or she may choose to file a wage and hour lawsuit against his or her employer.
And that is what several assistant managers have done after they claim Abercrombie failed to pay them the proper overtime rate. Filed in the Eastern District of New York, this federal lawsuit has been joined by more than just the three who initially started it. It is currently unknown how many assistant managers have not been properly paid the 1 1/2 times their regular wage for overtime worked.
Fortunately for three assistant managers, Abercrombie has agreed to settle their claims for nearly $10,800. In addition, the company will pay the managers’ attorney’s’ fees and court costs. Whether any managers who subsequently join the lawsuit or claim to have been underpaid by Abercrombie will be eligible for similar payouts remains uncertain.
Whenever someone has to work overtime it is a sign that he or she is in a demanding job, so not being paid properly for it can be particularly difficult. While many of us don’t work solely for the money, it is undeniably an important part of why we work. Not being paid for that work is something that should not be tolerated.
