Fighting For What You Have Rightfully Earned

Federal law states that nonexempt employees, or those entitled to overtime pay, must receive compensation if they work over 40 hours.

However, not all employers follow this law and instead take advantage of their employees by classifying them as exempt and not paying them overtime.

At Kessler Matura P.C. , we understand the importance of fair pay in exchange for the long hours you dedicate to your job. You have rights concerning your wages and overtime pay. When your employer fails to recognize this, we will hold them accountable to obtain what you fairly earned.

Overtime Standards Across New York

In New York and across the country, employees who are not exempt must receive overtime pay for all hours worked over 40. The Fair Labor Standards Act (“FLSA”) and the New York State Minimum Wage Act are the federal and state laws which regulate overtime pay.

In New York, nonexempt employees are entitled to:

  • Receive overtime pay for any extra hours worked in a 40-hour work week
  • Receive overtime pay that is one-and-a-half times their regular pay rate
  • Receive overtime pay in the form of wages, rather than gifts, extra time off or more
  • Receive overtime pay for extra hours worked even if the employer has a no-overtime policy

To determine your eligibility for overtime pay based on your role and occupation, consult with an experienced employment law attorney.

Protecting The Rights Of Employees

Many employees are hesitant to confront their employer after overtime hours go unpaid. You may worry about retaliation or being viewed as a nuisance. However, when your overtime hours are unpaid, your employer may be breaking the law.

Our lawyers fight for employees. We are experienced employment law attorneys who look after your rights when your employer fails to. When you don’t receive earned overtime pay , we will hold your employer responsible through proving their violation of the FLSA, state labor laws or both.
