Shulman Kessler LLP announces that it has filed a class action lawsuit on behalf of the current and former employees of George Martin Restaurant of Rockville Centre and Grillfire Restaurant of Merrick, alleging that the restaurants failed to pay its employees overtime premium pay for those hours worked in excess of 40 per week. The plaintiff is a former employee of the restaurants, who frequently worked in excess of 40 hours per week.
The complaint, which was filed in the United States District Court, Eastern District of New York, is titled Saramiento v. Showtime Dining LLC, et al. , and was assigned to the Hon. Joseph F. Bianco, U.S.D.J. and William D. Wall, U.S.M.J. - Docket Number - 10CV1926, alleges that the defendants had a policy and practice of requiring its employees to work in excess of 40 hours per week, without providing them with overtime premium pay.
The plaintiffs are seeking their back wages and liquidated damages under the Fair Labor Standards Act and the New York State Labor Law.
